MINUTES

Members Present: Matt Kennedy, Michael Scott, Ken Strom, Robert Lowell, and Anthony Costello.

Members Absent: Dan Hazen

Staff Present: Pamela Harding, Teresa McIntyre

Others: T. Broder, J. Robinson, M. Friend, S. Sundin, J. Lizotte, and P. McManus.

The meeting began at 7:00 PM.

TROUT BROOK WILDLIFE AREA RESTORATION - Pack 46 and Troop 182 - M. Friend, a representative of Pack 46, presented the proposal to continue the project started by Wachusett Greenways to restore the upper field habitat at Trout Brook.  The project includes removing trees, saplings, and brush from the upper field. They also will be clearing storm debris from the Red and Blue trails. A. Costello requested that the field mowing be done late in the year annually or biannually so as to not disturb the nesting birds. The Commission unanimously supported the project.

NOTICE OF INTENT - Winterberry Hollow - T. Broder addressed the Commission regarding his client's response to the Graves Engineering letter dated February 10, 2009 and DEP's advisory letter. After much discussion, M. Kennedy requested that the language regarding the Erosion Control be put on the plans.

The floor was opened to comments from the public. J. Robinson, an abutter, felt that the Conservation Commission should wait until a response is received from DEP. J. Lizotte, also an abutter, agreed.

The Conservation Commission agreed to have P. Harding work on a draft of conditions while the Commission waits for a response from DEP. Continued until May 6th.

ENFORCEMENT ORDER - 96 Malden Street - K. Strom met with owner of property. This site has a 25' no-disturb zone, but the homeowner has repeatedly ignored the Enforcement Order and continues to disturb the area. The homeowner has been contacted several times by the Conservation Commission regarding this issue with no response. Based on the lack of compliance by the owner, the Conservation Commission has proposed a fine of $300 per day from the original day they were notified of the violations. P. Harding will draft the letter.

OAKS OF HOLDEN - EXPIRED NOI - WALL FAILURE - Retaining wall has collapsed into wetland area. Currently, Homeowner Association and developer are determining who is responsible for costs. Replication has not been completed as well. Once it is determined who is responsible, the Conservation Commission can issue a response.

APPROVAL OF MINUTES - A. Costello made a motion to accept the Minutes of March 18, 2009. K. Strom seconded the motion. All were in favor.

M. Scott made a motion to adjourn. R. Lowell seconded the motion. All were in favor.

The meeting adjourned at 8:10 PM.

The next meeting is scheduled for May 6, 2009.
